TATA Play Netflix Combo Offer

Tata Play Netflix Combo (‘Offer’) is a promotional scheme which is being offered by Tata Play Limited (formerly known as Tata Sky Limited) (‘Tata Play’) to its Eligible Subscribers. Eligible Subscriber shall mean a Tata Play Subscriber who has an Active Account Status with or without a Netflix Account.
Eligible Subscriber who avails the Offer shall be provided with a Netflix Subscription as part of the Offer A subscriber with an existing Netflix subscription shall also be able to avail the Offer.
Eligible Subscribers can avail the offer through:
- Tata Play App
- Tata Play Website: By logging on to www.tataplay.com.
- Tata Play Helpline: By calling Tata Play helpline, anytime between 00:00 hours (IST) and 23:59:59 hours (IST).
- Authorized Dealer: By visiting an authorized dealer of Tata Play.
Eligible Subscriber shall have the option to choose any of the Tata Play bundles. Tata Play reserves the right to change the rates of any of its bundles at any time as it deems fit, as per applicable laws.
The Netflix service is provided by Netflix Entertainment Services India LLP. The other services included in the Offer are provided by Tata Play.
In order to enjoy the Netflix service as part of Offer, Eligible Subscriber will need to activate the Netflix service by completing the Netflix activation process. Eligible Subscriber will receive instructions on how to activate the Netflix service via email and/or text message.
If Eligible Subscriber already have an existing Netflix account, he/she can link it to his/her Offer when he/she activate Netflix as part of Offer. Eligible Subscriber will continue to be charged separately for any existing Netflix account until he/she link that account to his/her Offer. If Eligible Subscriber links an existing Netflix account to his/her Netflix Combo Pack offer, terminating the Offer will not automatically cancel Eligible Subscriber’s Netflix membership, and Netflix will automatically resume charging his/her existing payment method that they have on file once his/her Offer ends. The Eligible Subscriber agree that during activation of the Offer, Tata Play will; provide Netflix with: (i) the Eligible Subscriber’s email address (if available) and phone number.
The day of activation for availing the Netflix through any Offer would be considered as the 1st day of activation of the Offer.
In case the Netflix Combo Pack subscription of an Eligible Subscriber is dropped during the paid subscription, the Netflix subscription will be terminated at the end of monthly billing cycle of Netflix.
Netflix Service is not owned or controlled by the Company. Neither the Company has control over nor assumes any responsibility for the Netflix Service Plan or services or its content, privacy policies, or practices.
After the expiry of the monthly subscription, the Subscriber will be charged prevailing charges and this amount will be debited from his/her Tata Play Wallet next month’s subscription. For avoidance of doubt, all the charges shall be on monthly basis and such charges shall be debited from his/her Tata Play Wallet, immediately.
Any subscriber that wishes to upgrade his Netflix subscription to Netflix Standard or Netflix Premium can do so immediately through web, app or calling Tata Play Customer Care. In such cases, the Eligible Subscriber would be incrementally charged only the differential amount for the rest of the billing period.
A subscriber can cancel the combo offer subscription anytime by calling the Tata Play customer care.
The Company reserves the right to decide the eligibility of the Subscribers to whom the Offer would be offered.

In the event Tata Play requires any Subscriber to provide any required information, including documents to ascertain the eligibility of the Subscriber, then such Subscriber shall provide such information and documents to Tata Play.
This Offer cannot be combined for additional discounts, nor can any offers be clubbed to avail this Offer. This Offer is non-transferable, not for resale, and not redeemable for cash.
In addition to the terms and conditions stated here, the Subscribers shall be bound by the terms and conditions stipulated in the Subscription Contract and such other documents, that may be all found on the Tata Play website -www.tataplay.com. The documents referred above will be collectively referred herein as 'Subscription Contract’.
Any and all taxes and/or levies applicable in relation to this Offer shall be solely borne by the Subscribers.
Tata Play will not be responsible for any loss or damage caused to the Subscribers if this Offer is cancelled and/or withdrawn by Tata Play due to reasons beyond the reasonable control of Tata Play including without limitation force majeure events such as war, natural calamities, epidemics, pandemics, floods, failure of telecommunication network, satellite technology failure, regulatory approvals etc.
By availing this Offer, it shall be deemed to be construed that the Subscribers have read and consented to the terms and conditions stated here in and in the Subscription Contract and Privacy Policy www.tataplay.com.
Tata Play reserves the right to disqualify any Subscriber from receiving the Benefits of the Offer and/or refund of Security Deposit, at its sole discretion, if it identifies any fraudulent activity being carried out for the purpose of availing the benefits under the Offer or for any reason whatsoever.
Tata Play reserves the right to change any or all the packs and/or withdraw the packs and/or stop the transmission of any or all the Channels at any time, without assigning any reason and without any prior notification to the Subscriber and without any liability whatsoever, subject to applicable laws.

The Subscriber and/or any person through the Subscriber shall waive any and all right that such an individual may have to claim ambiguity in these terms and conditions. The Subscriber and/or any person through the Subscriber undertakes to release, indemnify and hold harmless Tata Play and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from the Subscriber availing this Offer.
All capitalized terms used herein shall have the same meaning as ascribed to them in the Subscription Contract.
In the event of any inconsistency between the Subscription Contract and these terms and conditions, in so far as this Offer is concerned, the later shall prevail.
Headings used herein are for convenience only and do not affect the interpretation of these Terms and Conditions.
Any disputes, differences or questions, which may arise at any time hereafter between Tata Play and the Subscriber (individually referred to as ‘Party’, and collectively as ‘Parties’), touching the true construction of these terms and conditions or performance of the obligations or enforcing any rights and/or liabilities of the Parties hereunder, shall be first amicably resolved between the Parties within 30 (thirty) days from the date on which such dispute was raised by a Party and communicated to the other Party in writing failing which the dispute shall be referred to a sole arbitrator of the Indian Council of Arbitration (ICA). The arbitration shall be conducted in accordance with the Rules of Arbitration of the Indian Council of Arbitration and shall be subject to the provisions of the Arbitration and Conciliation Act, 1996, as amended or any statutory modifications or re-enactment thereof for the time being in force. The venue of such arbitration shall be at Mumbai and the Courts at Mumbai alone shall have exclusive jurisdiction to deal with the arbitration proceedings and the awards in accordance with law. The arbitration proceedings shall be conducted in English language. The award passed by the arbitrators shall be final and binding upon the Parties.
Subject to the arbitration clause, these terms and conditions shall be construed and governed by the laws of India and the Parties agree to submit to the sole and exclusive jurisdiction of the courts of Mumbai.
