Tata Group Offer
A. Offer:
- Tata Group Offer (‘Offer’) is being offered by Tata Play Limited (‘Tata Play’) for its Customers. Customers shall mean to together include an Existing Tata Play Subscriber and a New Subscriber who completes a one-time purchase of a television or refrigerator or an air conditioner, from Croma outlet in Mumbai or Delhi NCR, as detailed under point 18 of this Offer terms and conditions.
For clarity, “Existing Subscribers” shall mean subscriber who already has a Tata Play connection, and “New Subscribers” shall mean any person who does not have a Tata Play connection and is a potential subscriber.
- This Offer is effective from 4th April 2024 at 00:00 hours.
- Under this Offer, Customer will receive the following benefits:
- Customers will be provided with a Tata Play subscription voucher which shall be valid till 31st July 2024.
- For New Subscribers: Eligible for free box (HD/ Binge+) – subscription shall be charged as per applicable rates. The New Subscriber can opt for 1+3 boxes (one primary + three secondary boxes) free of cost.
- For Existing Subscribers:
- Eligible for a cashback of Rs 501/- to the Tata Play account.
- Eligible to avail free HD or Binge+ Box Upgrade/Multi TV. The Existing Subscriber can opt for a free upgrade of all the existing boxes - 1+3 (primary + secondary boxes).
B. OFFER PROCESS, TERMS AND CONDITIONS:
- In order to avail the service of Tata Play, a Customer shall complete a one-time purchase of a television or refrigerator or an air conditioner from any of the stores of Croma in Mumbai location or Delhi NCR.
- Post the successful purchase, the Customer shall be provided with the Offer voucher with a QR code, which upon scanning would open Tata Play WhatsApp handle.
- Once the Customer lands on this chat box, the below message to be auto populated along with the voucher code:
“Is this the start of something special? Here is an offer from Tata Play to you. To get started, simply press SEND to share your special code: <>”
- Once the Customer hits send, a follow up message will be:
“Hooray! 🎉 Your offer is in process.
We will reach you from the number 020-6311-1202 📞 to set up an appointment. 🗓️🤝.”
- For clarity, please note that Customers going forward with the WhatsApp process, shall be considered as a consent for Tata Play representatives to connect with the Customer.
- Should the Customer wish to initiate this process at a later time or in case of a drop off as the Customer needs more time to decide, the Customer has the option to reinitiate the WhatsApp chat by scanning the QR code.
- For New Subscribers, Tata Play Representative shall explain the (primary, Primary + Multi TV) special box free (HD / Binge+) offer. that Tata Play has brought exclusively for this customer asking if the customer is interested.
- For Existing Subscribers, Tata Play Representative shall explain the Rs. 501/- cashback as a Welcome gift, this will be applicable for both active & de-active account.
- In case the Existing Subscriber has one Subscriber ID:
(a) the representative should process INR 501/- cashback to the same Subscriber ID
(b) However, for multiple Subscriber IDs, the representative confirms on which Subscriber ID the Existing Subscriber would like to receive cashback and process the same accordingly. The Existing Subscriber can also opt for a free HD/Binge+ Upgrade or a free HD/Binge+ Multi TV across their primary and secondary boxes.
- Cashback shall be triggered automatically once the coupon is consumed by the representative.
- Tata Play reserves the right to decide the eligibility of the Subscribers to whom this Offer would be offered.
- Once a Customer confirms that they are interested in subscribing, a WO will be raised, and a representative of Tata Play will confirm with the Customer their preferred time of visit for installation.
- Post the installation, the in-home call by the Tata Play representative shall explain the below:
- Pack Selection for the Customer
- OTT offer description
- TPMA Manage Packs
- Online Recharge Process
- Any sale under this offer will be under the Sale Model only.
- The conversion data should capture against what product the Voucher was redeemed – Free Box/ Recharge/ Free Upgrade/Free Multi TV
- In case a Customer wants to make changes to the pack then agent should educate that they can go to Manage Packs section on Tata Play Mobile App (“TPMA”) or tataplay.com, email ID <help@tataplay.com> of the customer care shall also be provided on the coupon as a support in case a Customer needs help.
- Tata Play reserves the right at any time, without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of the terms and conditions or to replace, wholly or in part this offer or to withdraw it completely or to change the composition of the Offer.
- This Offer is only for Mumbai location (Thane, Mumbai, and Navi Mumbai) and Delhi NCR (Delhi, Faridabad, Ghaziabad, Noida and Gurugram)
- Customer shall be eligible to redeem the Offer only once over a single call as detailed in the aforementioned points
- Tata Play representative shall connect with the Customer during working hours on weekdays. For clarity, working hours shall mean 9 AM - 6 PM
C. GENERAL TERMS AND CONDITIONS:
- Offers cannot be combined for additional discounts nor can any offers be clubbed to avail this Offer. This Offer is non-transferable, not for resale, and not redeemable for cash.
- In the event Tata Play requires any Customer to provide any required information, including documents to ascertain the eligibility of the Customer, such Customer shall provide such information and documents to Tata Play.
- In addition to the terms and conditions stated here, the Customers shall be bound by the terms and conditions stipulated in the Tata Play DTH Subscription Contract and such other documents, that may be all found on the Tata Play website - tataplay.com. The documents referred above will be collectively referred herein as 'Subscription Contract.’
- Any and all taxes and/or levies applicable in relation to this Offer shall be solely borne by the Customers.
- Tata Play will not be responsible for any loss or damage caused to the Customers if this Offer is cancelled and/or withdrawn by Tata Play due to reasons beyond the reasonable control of Tata Play including without limitation force majeure events such as war, natural calamities, epidemics, pandemics, floods, failure of telecommunication network, satellite technology failure, regulatory approvals etc.
- By availing this Offer, it shall be deemed to be construed that the Customers have read and consented to the terms and conditions stated here in and in the Subscription Contract.
- Tata Play reserves the right to change any or all the packs and/or withdraw the packs and/or stop the transmission of any or all the Channels at any time, without assigning any reason and without any prior notification to the Customer and without any liability whatsoever, subject to applicable laws.
- Tata Play shall not be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the charges that may be payable by the Customer to any network operator including any premium rates that may be charged by the network operator. Customers must check with their respective network operators regarding the charges payable to the network operator before using any of the methods mentioned above. Any dispute in connection with the same should be settled between the Customers and the network operator without involving Tata Play.
- Tata Play reserves the right at any time, without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of the terms and conditions or to replace, wholly or in part this Offer or to withdraw it completely or to change the composition of this Offer.
- By availing this Offer, it shall be deemed to be construed that the Customer has read and consented to the terms and conditions stated herein and in the Subscription Contract.
- The Customer and/or any person through the Customer shall waive any and all right that such an individual may have to claim ambiguity in these terms and conditions. The Customer and/or any person through the Customer undertakes to release, indemnify, and hold harmless Tata Play and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders, and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from the Customer availing this Offer.
- Tata Play shall not be responsible for printing or typographical errors in any promotional materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access the Tata Play website or process any transaction thereon.
- All capitalized terms used herein shall have the same meaning as ascribed to them in the Subscription Contract.
- In the event of any inconsistency between the Subscription Contract and these terms and conditions, as far as this Offer is concerned, the later shall prevail.
- Headings used herein are for convenience only and do not affect the interpretation of this Offer Terms and Conditions.
- Any disputes, differences or questions, which may arise at any time hereafter between Tata Play and the Customer (individually referred to as ‘Party’, and collectively as ‘Parties’), touching the true construction of these terms and conditions or performance of the obligations or enforcing any rights and/or liabilities of the Parties hereunder, shall be first amicably resolved between the Parties within 30 (thirty) days from the date on which such dispute was raised by a Party and communicated to the other Party in writing failing which the dispute shall be referred to a sole arbitrator of the Indian Council of Arbitration (ICA). The arbitration shall be conducted in accordance with the Rules of Arbitration of the Indian Council of Arbitration and shall be subject to the provisions of the Arbitration and Conciliation Act, 1996, as amended or any statutory modifications or re-enactment thereof for the time being in force. The venue of such arbitration shall be at Mumbai and the Courts at Mumbai alone shall have exclusive jurisdiction to deal with the arbitration proceedings and the awards in accordance with law. The arbitration proceedings shall be conducted in English language. The award passed by the arbitrators shall be final and binding upon the Parties.
- Subject to the arbitration clause, these terms and conditions shall be construed and governed by the laws of India and the Parties agree to submit to the sole and exclusive jurisdiction of the courts of Mumbai.
