Tamil Thalaiva HDS

TATA PLAY LIMITED (“TPL”) is offering a promotional offer under its subscription pack viz., “Tamil Thalaiva HDS” on its channel named as Sony Sports Ten 4 HD (“Channel”) only for its Subscribers who have subscribed to Tamil Thalaiva HDS.

By reading these terms and conditions regarding the “Tamil Thalaiva HDS” Promotional Offer (hereinafter referred to as the ‘Promotional Offer’) you irrevocably and unconditionally accept the same and you undertake to be bound by all the conditions contained therein without any kind of contestation and/or demur.

With T&Cs for the Promotional Offer, you accept and agree to the following:-

  1. The Promotional Offer shall commence on Channel from 8th January 2025 to 1st March 2025 (both days inclusive), from 12 p.m. upto 12 a.m. (“Promotional Offer Period”) as per the details provided hereinbelow.
  2. Eligibility for Participants under 18 years of age:

    By entering this contest, Participants who are under the age of 18 (a “Minor”) confirm that they have obtained the prior written consent of their parent or legal guardian to participate. The parent or legal guardian must also agree to these Terms and Conditions on behalf of the Minor.

    TPL and Organizers reserve the right to request proof of age from any participant and may disqualify any participant who fails to provide satisfactory proof of age or consent.

  3. This Contest is open to Indian Citizens resident in PAN India.
  4. This Contest and the Promotional Offer are being organized and managed by TPL.
  5. Below are the details of Promotional Offer:
    1. Tamil Thalaiva HDS is a TPL curated pack priced at Rs.269/- per month (inclusive of applicable Network Capacity Fee (“NCF”) and taxes)
    2. Pack details and Channel line-up are provided at the end of this T&Cs.
    3. Channel is a pay TV channel priced at Rs. 22.42 per month (inclusive of taxes)
    4. All Subscribers who hold the Tamil Thalaiva HDS monthly pack will get to see the Channel at no additional cost during the Promotional Offer Period.
    5. The Channel will not be added to the Long Duration pack (LDP) versions of the Tamil Thalaiva HDS pack.
  6. The Promotional Offer is available for TPL’s Subscribers who have given full details of their Name, permanent address, Income Tax PAN (in case of Minor, his / her parent’s or legal guardian’s), Phone number, age and such other details as may be prescribed by TPL.
  7. The Promotional Offer may be modified during the Promotional Offer Period as deemed fit by TPL at its sole discretion and may be extended or reduced as per the requirement of TPL. Promotional Offer cannot be exchanged /redeemed for cash or any other non-monetary consideration and the Promotional Offer is not transferable. Promotional Offer is subject to the laws of India and deduction of taxes, levies and other statutory payments shall be as applicable and borne solely by the Subscribers.
  8. Employees and family members of TPL and Sony are not eligible to avail of the Promotional Offer.
  9. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) / the Promotional Offer and in any and all entries received shall vest solely and exclusively with TPL at all times. TPL or any person or entity permitted by TPL in this regard shall be entitled to use the entries received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Subscriber.
  10. TPL reserves the right to change, defer, alter or cancel this Promotional Offer in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Decision of TPL in this regard and in general with respect to this Promotional Offer and the Terms & Conditions thereto shall be final, binding and non-contestable.
  11. Nothing contained herein amounts to a commitment or representation by TPL to conduct further or other offers/schemes.
  12. Under no circumstance, shall TPL and/or their directors, employees, officers, affiliates or subsidiaries, be liable to the Subscriber and/or any third party for any lost profits or lost opportunity, indirect, special, consequential, incidental, or punitive damages whatsoever, even if TPL has been advised of the possibility of such damages. The Subscriber specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against TPL and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Promotional Offer and shall hold harmless TPL, its affiliates, its group companies, their employees, officers, directors or any other person from any claim/liability/losses (including legal fees) arising out of and in relation to any injury/damage/harm/loss/ death/ mental or emotional trauma suffered by the participant(s) in any manner whatsoever in connection with the Promotional Offer.
  13. The Subscriber waives his/her/their right to file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against TPL and/or any parties related to the Promotional Offer to claim any damages or any reliefs or otherwise.
  14. Subscriber hereby agrees to indemnify, defend and hold harmless TPL, its officers, affiliates, directors, employees, agents, from and against any and all claims, damages, losses, liabilities, costs and expenses (including but not limited to reasonable attorneys’ fees) arising from or relating to Subscriber’s unauthorized use of Promotional Offer and infringement of TPL and third-party intellectual property rights.
  15. The Contest and the terms and conditions shall be governed by and construed in accordance with the applicable laws in India. All matters with respect to the Contest are subject to the exclusive jurisdiction of the Courts at New Delhi only. The contest is void where prohibited by law.
